Minutes:

Cllr Connett highlighted the fact that Cllrs Evans, Nuttall and himself were members of the Liberal Democrats of which Cllr Eden was also a member.

 

Cllr Cox stated that in his professional capacity he wrote the Articles of Association for the air show and he advised them on obtaining funding.

 

John Austin the Investigating Officer stated that he knew the Democratic Services Team Leader via a professional body.

The Committee will consider the Investigator’s Report regarding alleged breaches by District Cllr Alison Eden of Teignmouth Town Council Code of Conduct as follows:

 

(a)      Introduction by Chair

(b)      Report summary by Investigator

(c)       Representations from Cllr Eden and questions from the Committee on:

(i)   report sections regarding the findings of fact and

(ii)     whether a breach of the Code has occurred

(d)      Comments (if any) from Independent Persons and Parish Representative

(e)      Committee adjourn (with Independent Persons and Parish Representative) to determine whether breach occurred and only if a breach is found, which of the following available sanctions (if any) should be imposed:

·       Public censure / reprimand

·       Apology to the complainants

·       Publish the Committee’s findings

·       Training

The Committee considered the published report in line with the procedure set out in the agenda.

The Committee went into confidential session to consider the Investigator’s recommendations regarding the alleged breaches of the Code of Conduct.

 

RESOLVED

 

Having made a finding of facts as set out in its Decision Notice, the Committee concludes that Cllr Eden breached the Members’ Code of Conduct as provided for in the Decision Notice and that:-

 

(a)   Cllr Eden must provide a public letter of apology within 5 workdays of the decision being notified to her (to be agreed with the Chair of Standards Committee) to Teignmouth Town Council for her conduct; and

 

(b)   The Committee also decided to send a letter to Teignmouth Town Council asking them to review how they deal with conduct and behaviour within their Council taking account of course of proposed changes and recommendations as are currently pending from the LGA and/or advised Committee for Standards in Public Life.
