Members voted unanimously to thank the Officers who produced the document for the work put into it.

 

Members were advised that the Council, as the licensing authority, is responsible for licensing including entertainment, the sale and supply of alcohol and late night refreshment and are legally required, under the Licensing Act 2003, to review every 5 years its Statement of Licensing Policy.

 

The Licensing Manager advised that the revised Policy incorporated changes to legislation and guidance. Members were also advised that the draft document has had sections moved to make the policy flow better and some sections reworded to read better and be more easily understood by the public, applicants and also for Members. The Licensing Manager also advised that a new paragraph in relation to safeguarding has been added.

 

During discussion, particular reference was made to:-

 

(a)  Paragraph 3.4.1 in relation to inspections only being carried out when necessary.  Councillor Rollason proposed this include high risk properties.  This was seconded by the Chair and passed unanimously.

 

(b)  Paragraph 4.5.10 and confirming the immigration status of applicants.  The Licensing Manager confirmed that this is a universal question and all applicants are asked this on the relevant application forms.

 

(c)  Paragraph 4.5.11 and why disabled access conditions are not attached to the document.  The Licensing Manager confirmed that they are dealt with by other legislation.

 

The Chair proposed that the licensing policy subject to the amendment at paragraph 3.4.1 be put out to consultation. This was seconded by Councillor Russell and unanimously resolved.

 

RESOLVED

 

To approve the consultation process to review the licensing policy as set out in the agenda report subject to the inclusion of high risk properties as set out at paragraph 3.4.1 in relation to inspections only being carried out when necessary.
